Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and SJ Bilingual Services ("Company," "we," "us," or "our") concerning your access to and use of our website and language services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.
Description of Services
SJ Bilingual Services provides language services including, but not limited to, document translation, interpretation services, bilingual education, localization, transcription, and cultural consulting. The specific scope of services will be defined in separate agreements or statements of work for each engagement.
No Guarantee of Outcomes
While we strive to provide accurate and high-quality language services, we make no guarantees, representations, or warranties regarding specific outcomes, results, or business impacts.
The success of any translation, interpretation, or localization project depends on numerous factors, many of which are outside our control, including but not limited to: client implementation, market conditions, cultural nuances, and third-party dependencies. Past results do not guarantee future outcomes.
Service Relationship
Our relationship with you is that of an independent service provider. Nothing in these Terms or any engagement creates:
- An employer-employee relationship
- A partnership, joint venture, or agency relationship
- A fiduciary relationship or duty beyond what is expressly stated
- Any obligation to provide ongoing services beyond the scope of a specific engagement
We provide professional language services based on our expertise and the information provided to us. You retain full decision-making authority and responsibility for your content and its use.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL SJ BILINGUAL SERVICES, ITS TRANSLATORS, INTERPRETERS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
- WE SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMING OUR OBLIGATIONS WHERE SUCH FAILURE OR DELAY RESULTS FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL.
SMS Communication Terms
If you opt in to receive SMS communications from us, the following terms apply:
- Message Frequency: Up to 10 messages per month.
- Costs: Message and data rates may apply.
- Opt-Out: Reply STOP to any message to opt out.
- Help: Reply HELP for assistance.
- Consent Not Required: Consent is not a condition of purchase.
Intellectual Property
All content, materials, translations, and intellectual property on our website and in our services are owned by SJ Bilingual Services or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in State of Texas.
